Heard learned counsel for petitioner and learned State Counsel for opposite parties no. 1 to 4. Notice on behalf of opposite party no. 5 has been accepted by Mr. Pankaj Gupta Advocate. In view of order being passed, notice to opposite parties no. 6 to 9 stands dispensed with.

Petition has been filed in the nature of Public Interest Litigation (PIL) seeking a direction to the opposite parties no. 1 to 3 to take necessary action for removal of illegal encroachments over Gata No. 104 recorded in the name of Gaon Sabha concerned.

In pursuance of directions issued earlier by this Court, learned State Counsel on the basis of instructions received from Tehsildar Kaisarganj dated 01.04.2024 submits that as of now there are no illegal encroachments over the Gata No. 104 situate in Village- Moose Patti, Tehsil- Kaisarganj, Pargana and District- Bahraich and further submits that on the aforesaid Gata No. 104, which is part and parcel of abadi, on the remaining portion recorded as Naveen Parti, and Aganbari Kendra is existing for passed 15 years alongwith Vyas Asan for use of the villagers.

In view of aforesaid, learned counsel for petitioner on the basis of instructions submits that petitioner will be granted liberty to approach the authorities concerned under Section 67 of the U.P. Revenue Code 2006.

Considering aforesaid submissions, petitioner is granted liberty to approach the competent authority under Section 67 of the U.P. Revenue Code 2006 in case he so desired which may be decided expeditiously if filed.

With aforesaid directions, petition stands disposed of.
