Heard Shri Meva Lal Yadav, learned counsel for the appellant.

This first appeal from order has been filed against the impugned order dated 12.08.2024 passed in Regular Suit No. 1645 of 2024, Praveen Verma vs. Subash Chandra Shukla by Civil Judge, Senior Division, Shrawasti by means of which the interim injunction dated 01.07.2024 has been modified and the order of status quo has been passed and the case has been listed for disposal of application for interim injunction (C6).

Learned counsel for the appellant, after arguing at some length, submits that the application for interim injunction filed by the appellant i.e. 6C has not been disposed of till date, therefore, he restricts his prayer for a direction to the concerned court to consider and dispose of the said application for interim injunction (C6) filed by the appellant within some short stipulated period in accordance with law.

Considering the nature of order proposed to be passed notice to the respondents is dispensed with.

Without entering into the merit of the case, the appeal is disposed of with liberty to the appellant to move appropriate application before the concerned court for expeditious disposal of the application for interim injunction (C6). In case, any such application is moved by the next date fixed in the lower court i.e. 19.10.2024, the concerned court shall consider the same and make endeavor to decide the application for interim injunction expeditiously in accordance with law after affording opportunity to the parties without granting unnecessary adjournment to either of the parties.
