Heard Sri Avinash Singh, Advocate, holding brief of Sri Raj Mani Dubey, learned counsel for the petitioner and Ms. Nidhi Singh, Advocate holding brief of Sri S.P. Tewari, learned counsel for the respondents no. 2 & 3. Sri Anand Dwivedi, Advocate is present for respondent no.1.

With the consent of learned counsel appearing for the contesting parties, the writ petition is finally being disposed of.

The present petition has been filed with the following main prayer:

"i. issue a writ, order or direction in the nature of Mandamus directing to the opposite party No.3 Additional General Manager, ITI Limited, Doorbhash Nagar, Rae Bareli, U.P. to pay post retiral dues total amount of privileged leave encashment payable to the Petitioner, which are admittedly due on account of holidays available for the values of Rs.3,25,606/- along with interest."

The contention of the Counsel for the petitioner is that despite admission as contained in Annexure-3 to the writ petition, the amounts have not been paid to the petitioner.

Considering the submission advanced and perusing the documents on record, the present petition is disposed of directing the respondent no.3 to ensure the payment of the admitted dues to the petitioner within a period of six weeks from the date of approaching and filing a certified copy of this order before the respondent no.3.

It is further provided that the opposite party shall also consider for payment of interest at the rate of 7%, if the rules permits so.
