Heard Shri Ashutosh Srivastava, learned counsel appearing for the petitioner, learned Additional Chief Standing Counsel appearing for the respondent no. 1 and Ms. Pallavi Singh, Advocate holding brief of Shri Ram Kumar Singh, learned counsel appearing for the respondent no. 2 and 3.

There is a consensus at the bar that the matter in issue is squarely covered by the judgement and order of this Court passed in a bunch of writ petitions leading being Writ - A No. 9311 of 2023 in re: Kamta Prasad Shukla (K.P. Shukla) Vs. State Of U.P. Thru. Addl. Chief Secy., Deptt. Of Chini Udyog Evam Ganna Vikas Lko And 2 Others decided on 13.12.2023 (Neutral Citation No. - 2023:AHC-LKO:81839) .

Considering the aforesaid consensus and the issue involved in the instant petition which also pertains to punishment order of withholding of two increments with cumulative effect vide order dated 14.02.2017, a copy of which is Annexure No. 2 to the petition, and the petitioner having retired after attaining the age of superannuation on 31.01.2020 as expressly stated in paragraph four to the petition consequently, as per the law laid down by this Court in the case of Kamta Prasad Shukla (Supra), the writ petition is allowed .

The order impugned dated 14.02.2017, a copy of which is Annexure No. 2 to the petition, along with order dated 19.09.2023, a copy of which is part of Annexure No. 1, to the petition are quashed.

It is provide that consequential benefits in terms of money shall be paid by the respondents within three months from today.
