Heard learned counsel for the petitioners and Sri Alok Srivastava, learned Standing Counsel for respondents no.1 to 4.

With the consent of learned counsels for the contesting parties the writ petition is being decided finally.

The contention of learned counsel for the petitioners is that the petitioners had filed an Appeal No.96 of 2023 under Section 21 of the Pre-Conception & Pre-Natal Diagnostic Techniques Act, 1994 in re: Sandhya Ultrasound Center, Ward No.16, Walipur Khurd, Gauriganj, District Amethi, through its owner Sri Amarjot Tiwari vs. District Magistrate, Amethi and another, on 03.10.2023, which is still pending before respondent no.1 and has yet not been decided.

Accordingly, without entering into the merits of the case but considering that the appeal filed by the petitioners is pending before respondent no.1, present petition is disposed of with a direction to respondent no.1 to decide the pending Appeal No.96 of 2023 as filed by the petitioners within a period of six weeks from the date of receipt of a certified copy of this order in accordance with law provided there is no legal impediment.
