Heard learned counsel for petitioner as well as learned State Counsel.

Learned counsel for petitioner submitted that the present writ petition has been preferred for issuing direction to respondent no. 1 i.e. Additional Commissioner Judicial, Ayodhya Division, Ayodhya, to decide the stay vacation application in Case No. 485 of 2024, Computerized Case No. C202404000000485 titled as 'Kesh Kumari versus Raj Dev and others' under Section 24(4) of the U.P. Revenue Code, 2006 (hereinafter referred as Code, 2006) pending since 01.04.2024.

On being specifically asked from learned counsel for the petitioner that whether petitioner has preferred any urgency application for early disposal of the application pending under Section 24(4) of the Code, 2006 by showing urgency in the matter before the Court concerned, it has been replied by learned counsel for the petitioner that no urgency application has been filed on behalf of the petitioner for early disposal of the application pending under Section 24(4) of the Code, 2006.

At this stage, learned counsel for the petitioner has submitted that present writ petition may be disposed of with a liberty to the petitioner to move an urgency application for early disposal of the application pending under Section 24(4) of the Code, 2006, and if any such application is preferred by the petitioner the same may be decided by the respondent no. 1 within the stipulated time this Court may fix.

Learned Standing Counsel has no objection to the prayer made by learned counsel for the petitioner.

On the request of learned counsel for the petitioner and without entering into the merits of the case, the present petition is disposed of with liberty to the petitioner to move an urgency application in stay vacation application in Case No. 485 of 2024, Computerized Case No. C202404000000485 titled as 'Kesh Kumari versus Raj Dev

and others' under Section 24(4) of the Code, 2006 pending since 01.04.2024. If any such urgency application is preferred, it is expected that respondent no. 1 shall make an endeavour to decide the urgency application expeditiously, in accordance with law, after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournment to either of the parties.
