Heard learned counsel for petitioners, learned State Counsel for opposite party nos. 1 to 3 and Mr. Atul Kumar Dwivedi, learned counsel for opposite party no. 4, whose power filed today is taken on record.

Petition has been challenging order dated 30.10.2023 whereby list of general body and managing committee for the year 2023-24 has been registered by the Deputy Registrar.

It is submitted that prior to service of the impugned order upon petitioner, he had filed Writ-C No. 9786 of 2023 on the ground that petitioners had applied for registration of list of office bearers and members which was still pending consideration. The said petition was disposed of vide order dated 07.11.2023 directing the opposite party no. 3 therein to consider petitioners' application dated 28.06.2023 in accordance with law. It is submitted that as on 07.11.2023, petitioners did not have any knowledge with regard to the impugned order dated 30.10.2023.

Nonetheless it thus transpires that after passing of impugned order dated 30.10.2023 registering the list of general body and managing committee has submitted by opposite party no. 4, this Court vide order dated 07.11.2023 has directed the concerned authority to consider petitioners' application as well. In order not to take a divergent stand from earlier directions passed by this Court on 07.11.2023, this Court finds it appropriate that the opposite party no. 3 i.e. Deputy Registrar, Firms Societies & Chits, Lucknow Mandal, Lucknow who was also opposite party no. 3 in the aforesaid writ petition shall consider and decide the claim of petitioner as well as opposite party no. 3 regarding registration of the list of officer bearers and members of managing committee expeditiously, preferably within a period of eight weeks from the date a certified copy of this order is

produced before the concerned authority.

It shall be open to the parties to take all objections in accordance with law.

Obviously, the impugned order dated 30.10.2023 shall abide by the final decision so taken in the said petition.

With aforesaid observations and directions, the petition is finally disposed of.
