Heard learned counsel for the petitioner and learned Standing Counsel for the State.

The present writ petition has been preferred for issuing direction to the respondent no. 2 to decide the representation made by the petitioner dated 13.09.2021.

Learned Standing Counsel has submitted that the matter of the petitioner has been forwarded to the State Government by Staff OfÏcer of the OfÏce of the Engineer in Chief vide its letter dated 13.09.2021 for considering the services of the petitioner during the suspension period to be treated as regular service which the petitioner is also praying in his representation.

Learned counsel for the petitioner has submitted that the petitioner has attained the age of superannuation and retired from the services on 30.06.2022 and due to the claim as mentioned above, the lessor amount or postretiral dues have been paid to the petitioner.

As informed by the learned Standing Counsel that the matter is pending before the respondent no. 1, petitioner is given liberty to make a representation to the respondent no. 1 within a period of one week along with a certified copy of this order and respondent no. 1 i.e. Additional Chief Secretary, Home, Civil Secretariat, U.P. Lucknow is directed to take a decision in the matter within a period of six weeks from the date of production/receipt of certified copy of this order along with the copy of the said representation.

Writ petition is disposed of accordingly.
