Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

The applicant seeks enlargement on bail in FIR No. 247 of 2023, under Sections 363,302,201,120B IPC, Police Station Khodare, District Gonda.

It is argued that the co-accused with similar allegations, has been enlarged on bail vide order dated 26.4.2024 passed in Criminal Misc. Bail Application No. 3171 of 2024.

Learned AGA has opposed the bail application.

Considering the allegations against the applicant to be similar to the co-accused coupled with the fact that the applicant has no criminal history and is in custody since 1.11.2023, the applicant is entitled to be enlarged on bail on the ground of parity. In view thereof, the application is allowed .

Let the applicant- Alagu be released on bail in the aforesaid FIR number on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶13

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶14

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the

facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
