Heard learned counsel for the applicant, learned AGA and perused the record.

The accused-applicant seeks bail in FIR/Case Crime No.59 of 2024 under sections 498-A, 304-B IPC and section 3/4 D.P. Act, P.S. Paraspur, District Gonda.

It is argued by the counsel for the applicant that the applicant is the mother in law of the deceased and the husband who is the co-accused was enlarged on bail vide order dated 04.07.2024 in Bail No.7178 of 2024. It is further argued that the applicant was earlier granted the anticipatory bail by this court vide order dated 20.08.2024.

Considering and adopting the reasoning as contained in the order dated 04.07.2024 coupled with the fact that the applicant is a lady and is aged about 70 years, she is entitled for the bail. Thus the bail application is allowed.

Let the applicant Sundarpata be released on bail in aforesaid FIR/Case Crime Number subject to her furnishing a personal bond and two reliable sureties of Rs.20,000/- (Twenty Thousand) each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which she is accused or suspected of the commission; and

¶13

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
