5-Learned counsel for the applicant has submitted that the applicant is not named in the F.I.R. and his complicity came into light during investigation on the basis of information provided by the Registrar of the company. On 01.12.2007, applicant was appointed as Director of Tera Cap Investment Consultants Private Limited along with six other persons, namely, Rahul Srivastava, Renu Awasthi, Suman Gupta, Ishwar Saran Singh, Mast Ram Verma and Avadhesh Tripathi by the named accused Saurabh Mohan Srivastava, Chairman of the said company. It is also submitted that the applicant had also invested Rs. 1,50,000/- in the said company but on account of non payment of his dues and invested money, he had resigned on 18.06.2008. During investigation, arrest of the applicant was stayed vide order dated 07.06.2013 in writ petition being Misc. Bench No. 4777 of 2015. The applicant has criminal history of thirteen cases, which have been explained in paragraph no. 31 of the afÏdavit. Lastly, it is submitted that the applicant has apprehension of imminent arrest and in case, applicant is released on anticipatory bail, he would not misuse the liberty and would cooperate with the trial.
