Heard Shri Suneel Kumar Singh Kalhans, learned counsel for the petitioner, learned Additional Chief Standing Counsel and Shri Dwijendra Mishra, learned counsel for the respondent no.5/caveator.
Learned counsel for the respondent no.5 submits that this petition is not maintainable against the orders passed by the consolidation authorities because the consolidation authorities have only complied the judgment and order dated 07.09.2021 passed by this court in Writ Petition No.788 of 1986. The SLP filed by the petitioner has been withdrawn with liberty to claim title in appropriate proceedings.
Learned counsel for the petitioner could not dispute the same and submits that he has filed a suit for declaration before the Sub-Divisional Magistrate, under Section 144 of the U.P. Revenue Code- 2006 and further submits that the petition may be dismissed as not pressed with liberty to pursue the remedy availed by him. To which there is no objection by the other side.
In view of above, this petition is dismissed as not pressed with liberty as aforesaid.
