Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

2 . It is argued by the counsel for the applicant that this Court had enlarged two co-accused i.e. father and mother of the applicant on bail vide orders dated 03.01.2024 and 28.11.2023.

Considering the same analogy and reasoning as contained in the order dated 03.01.2024 and 28.11.2023 coupled with the fact that there is no allegation against the applicant that soon before the death, the deceased was subjected to any mental or physical harassment in relation to the demand of dowry, the applicant has no criminal history and is in custody since 15.07.2023 and there is nothing on record to demonstrate that the applicant if enlarged on bail, would in any way adversely affect the trial and without expressing any opinion on merit, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed .

4. Let the applicant Gurjeet Singh be released on bail in FIR/ Case Crime No. 0092 of 2023, under Sections 498A, 304B IPC and Section 3/4 D.P. Act, Police Station Bhira, District Lakhimpur Kheri, on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of

the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶12

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶13

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police ofÏcer or tamper with the evidence.
