Heard learned counsel for petitioners, learned State Counsel appearing on behalf of opposite parties no.1 and 2, Mr. Ravi Singh, learned counsel for opposite party no.3 and Mr. Raj Kumar Singh, learned counsel holding brief on behalf of Mr. D. K. Singh Chauhan, learned counsel for opposite party no.4.

Petition has been filed challenging circular dated 14.12.2023 issued by the Pharmacy Council of India New Delhi so far as it relates to petitioners' Institution. Further relief for direction to the opposite parties to extend approval as well as affiliation to petitioners' Institution for the D Pharm Course for Session 2024-2025 and for treating education Session 2023-2024 as zero session has been sought alongwith a prayer for a direction to opposite parties not to compel petitioners' Institution for applying afresh for D Pharm Course pertaining to Session 2024-2025.

At the very outset, learned counsel for petitioners on the basis instruction submits that he does not press prayer no.2 regarding circular dated 14.12.2023 and is restricting his prayer for a direction to opposite parties to consider and decide petitioners' representation with regard to his grievances.

Considering innocuous prayer being made by learned counsel for petitioners and without entering into the merits of the case petitioners are granted liberty to file a fresh representation before opposite party No.2 and 3 i.e. Secretary, Uttar Pradesh Board of Technical Education, Guru Govind Singh Marg, Lucknow & Secretary, Pharmacy Council of India, New Delhi collectively. In case such a representation is filed, the same shall be considered and decided within a period of eight weeks from the date a certified copy of this order is produced before the said authority.

With the aforesaid observation, petition stands disposed of .
