Heard Sri Arun Kumar, learned counsel for the applicant, Sri Anant Pratap Singh, learned A.G.A. for the State and perused the records.

The instant application has been filed seeking release of the applicant on bail in Case Crime No.154 of 2022, under Sections 419, 420, 467, 468, 471, 120-B I.P.C. registered at Police Station Kotwali Ayodhya, District Faizabad.

The aforesaid case has been registered on the basis of an F.I.R. lodged on 28.04.2022 against five persons stating that the co-accused Manjeet Mishra had persuaded the informant to purchase a land and the informant paid Rs.15,18,000/- as sale consideration and got sale deed executed on 22.03.2022 but later on he came to know that the sale deed had been executed by some imposter. During investigation it came to light that the sale deed had been executed by the applicant.

In the affidavit filed in support of bail application it has been stated that the applicant is innocent, he has been falsely implicated in the present case and he has no criminal history.

The learned counsel for the applicant had submitted that the co-accused Manjeet had taken the applicant under a false pretext of getting execution of a sale deed witnessed by the applicant. The co-accused Manjeet has already been granted bail by means of an order dated 23.01.2024, passed by this

court in Criminal Misc. Bail Application No.815 of 2024. Coaccused Ramdeen Chauhan in whose bank account the sale consideration was transferred has been granted bail by this court by means of an order dated 13.10.2023, passed in Criminal Misc. Bail Application No.12246 of 2023. Yet another co-accused Manoj Kumar has also been granted anticipatory bail by this court by means of order dated 22.02.2024, passed in Criminal Misc. Anticipatory Bail Application No.282 of 2024.

The learned A.G.A. has opposed the prayer for bail but he could not dispute the aforesaid aspects of the matter.

Having considered the aforesaid facts and circumstances of the case and without making any observation, which may affect the merits of the case, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime.

Accordingly, this bail application stands allowed .

Let the applicant-Ravi Prakash Pandey be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned, subject to following conditions:-

(i) the applicant shall not tamper with the prosecution evidence;

(ii) the applicant shall not pressurize the prosecution witnesses;

¶17

(iii) the applicant shall appear on each and every date fixed by the trial court, unless his appearance is exempted by the learned trial court.
