Heard Sri Chandra Kumar Rai, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.

By means of the instant petition, the petitioner is before this Court with prayer that the Restoration Application dated 03.11.2020 filed by the respondent No. 3 in Case No. 1016 (Mohd. Yahiya Vs. Niyamtullah) under Section 229-B of U.P. Z.A. and L.R. Act, 1950 now under Section 144 of U.P. Revenue Code, 2006 pending before the Sub Divisional Officer, Madhuban, Tehsil Madhuban, District Mau be directed to be decided expeditiously.

Learned Standing Counsel very fairly submits that in case any such application is pending, the same would be decided by the concerned authority.

In view of the above, without entering into the merit of the case, the writ petition, on consent, stands disposed of directing the respondent No. 2 i.e. Sub Divisional Officer, Madhuban, Tehsil Madhuban, District Mau to consider and decide the aforesaid application by a reasoned and speaking order in accordance with law expeditiously, preferably, within two months from the date of receipt of certified copy of this order.
