Heard learned counsel for the petitioner, Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the State respondents, Mr. Achal Singh, learned counsel appearing for the respondent no.3, Gram Sabha and Mr. Nand Kishor Mishra, learned counsel appearing for the respondent no. 4.

Counter affidavit filed on behalf of respondent no.4 is taken on record.

The instant petition has been filed for the following reliefs:-

"i. A writ, order or direction in the nature of mandamus commanding the Sub Divisional Magistrate Mahoba to forthwith decide the case as preferred by the petitioner before him in terms of Section 82 of the U.P. Revenue Code, 2006, with expedition.

ii. A writ, order or direction in the nature of Mandamus commanding the respondents to maintain status-quo over the concerned plot in question during the pendency of the present writ petition."

This Court vide order dated 20.07.2023 passed the following order:

"1. In view of the prayer made in the writ petition, learned Standing Counsel as well as Counsel for the Gaon Sabha are directed to obtain necessary instruction in the matter as to whether the application under Section 82 of U.P. Revenue Code, 2006 has been filed at the instance of the petitioner and case has been registered or not.

2. List this case in the additional cause list on 17.8.2023."

In pursuance of the order dated 20.07.2023, instructions dated 14.08.2023 is placed before the Court which is also taken on record.

Learned Standing Counsel on the basis of instructions dated 14.08.2023 submitted that restoration application has been filed by petitioner against the order dated 29.06.2021, passed in proceedings under Section 80 of U.P. Revenue Code,

2006, which is pending before the Sub-Divisional Magistrate, Mahoba. He further submitted that copy of the order sheet is annexed along with the instructions dated 14.08.20223 in order to demonstrate that the proceedings of restoration against the order dated 29.06.2021 is pending and the objections have been filed on behalf of the respondent no.4 in the restoration proceeding.

Mr. Nand Kishor Mishra, learned Counsel for the respondent no.4 submitted that petitioner's father and respondent no.4 are real brothers and are in possession of 1/2 share of plot no. 1087 area 0.324 hectare. He further submitted that proceeding under Section 80 of U.P. Revenue Code, 2006 has been decided vide order dated 29.06.2021 and revision filed by petitioner under Section 210 of U.P. Revenue Code, 2006 has been dismissed by Commissioner on the ground of alternative remedy as such writ petition filed by petitioner for mandamus to decide the case preferred by petitioner under Section 82 of U.P. Revenue Code, 2006 cannot be entertained.

Learned counsel for the petitioner submitted that order dated 29.06.2021 is wholly illegal as such petitioner has initiated proceeding under Section 82 of U.P. Revenue Code, 2006 which is pending accordingly necessary direction be issued for the disposal of pending proceeding, and till the disposal of pending proceeding, parties be directed to maintain status quo in the matter.

I have considered the argument advanced by learned counsel for the parties and perused the record.

In order to appreciate the controversy the perusal of the instructions sent by Sub-Divisional Officer, Mahoba dated 14.08.2023 along with the order sheet of pending restoration case will be relevant which are as under:-

The perusal of the instructions dated 14.08.2023 along with the order sheet dated 10.08.2023 demonstrate that Case No. RST/2759/2023, Computerized Case No. T202307480102759 under Section 80 of U.P. Revenue Code, 2006 is pending before respondent no. 2/ Sub-Divisional Officer, Mahoba.

In view of the pendency of the restoration application at the instance of the petitioner against the order dated 29.06.2021, under Section 80 of U.P. Revenue Code, 2006, the instant petition is finally disposed of directing the respondent no.2 to decide the restoration application filed by the petitioner against the order dated 29.06.2021 being Case No. RST/2759/2023, Computerized Case No. T202307480102759, in accordance with law expeditiously and preferably within a period of two months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
