Heard learned counsel for the petitioner and the learned Standing Counsel.
The present petition has been filed with the following prayer:
" Issue a writ order or direction in the nature of mandamus directing to the Respondent No. 2 Deputy Commissioner (Food) Varanasi Division, Varanasi, to decide the Appeal no.28 of 2022 district Varanasi, Hiravati Devi v. State of U.P (Annexure no.1 to this writ petition) is pending before him expeditiously within stipulated period. So, justice may be done."
Considering the fact that the appeal is pending adjudication before the respondent no.2, the present petition is disposed off directing the respondent no.2, Deputy Commissioner (Food) Varanasi Division, Varanasi, to decide the Appeal no.28 of 2022 district Varanasi, Hiravati Devi v. State of U.P (Annexure no.1 to this writ petition) within a period of three months from the date of production of a certified copy of this order.
