Heard Mr. Mohammad Mustafa, learned counsel for the petitioner as well as the learned Standing Counsel appearing for respondent Nos. 1 to 6 and perused the record.

Present petition under Article 226 of the Constitution of India has been filed seeking a direction to the Niyat Pradhikari/Up Zila Adhikari, Bansi, District Siddharth Nagar(respondent no.2) to decide the Petition No.19/2021/02352/2021 Computerized Petition No. T202117630202352(Akbar Ali vs. Mustak and others) within a stipulated time period.

It is submitted by learned counsel for the petitioner that opposite parties have put in appearance before the Authority and filed their objections in the election petition. It is further submitted that on account of delaying tactics adopted by private respondents, the election petition could not be decided and is pending since 24.5.2021.

Without going into merit of the case, it is appropriate that the above election petition be decided expeditiously.

In view of above, Niyat Pradhikari/Up Zila Adhikari, Bansi, District Siddharth Nagar-respondent no.2 is directed to decide the aforesaid election petition expeditiously, if possible within four months from the date of production of certified copy of this order without granting adjournment unnecessarily to either of the parties, unless there is any legal impediment.

With aforesaid direction, the instant petition under Article 226 of the Constitution of India is finally disposed of.
