Heard Sri Lalit Prakash, learned Advocate holding brief of Sri Narayan Swaroop, learned counsel for the petitioner and the learned Standing Counsel appearing for the State-respondents.
It is submitted by the learned counsel for the petitioner that the petitioner was fair price shop licence holder. On the complaint made against the petitioner, the said licence of the petitioner was cancelled by the Sub Divisional Magistrate, Bisalpur, District Pilibhit vide order dated 13.10.2022.
It is further submitted that the petitioner has preferred an appeal before the Deputy Commissioner(Food), Bareilly Region, Bareilly against the order of cancellation dated 13.10.2022 which was registered as Appeal No.80 of 2022. The petitioner is pressing the only prayer to decide the Appeal No.80 of 2022 as early as possible.
Learned Standing Counsel appearing for the State-respondents has no objection if the appeal filed by the petitioner is decided expeditiously.
Considering the submission of learned counsel for the petitioner and the learned Standing Counsel, the writ petition is disposed of with the direction to the respondent no.2-Deputy Commissioner(Food), Bareilly Region, Bareilly to decide the Appeal No.80 of 2022 expeditiously if possible within a period of three months from the date of production of certified copy of this order unless there is no any legal impediment.
