Heard Shri A.K. Dwivedi, learned counsel holding brief of Shri Shadab Alam, learned counsel for the petitioner, learned Standing Counsel for the State-respondents as well as Shri Rameshwar Prasad Shukla, learned counsel representing the Gaon Sabha.

The grievance of the writ petitioner is that despite the complaint moved with regard to encroachment over Arazi No. 36 Ka of Khata No. 00179, measuring area 0.1730 hectare and Arazi No. 43 of Khata No. 00181 measuring area 0.020 hectare situated in village Shekhwaliya, Pargana Bela Daulatabad, Tehsil Lalganj, district Azamgarh, no proceedings under section 67 of U.P. Revenue Code, 2006 have been registered by the court concerned, although the complaint was processed in January, 2023. Learned counsel further submits that as per section 67 (2) of the U.P. Revenue Code, 2006, proceedings can be registered either on the basis of report under section 67 (1) of U.P. Revenue Code, 2006 or otherwise and, therefore, the same may be directed to be registered and disposed of in accordance with law.

Having heard the learned counsel for the parties, this writ petition is being disposed of with the following directions:

(1) The court concerned shall consider the application of the petitioner within the ambit of section 67 (2) of U.P. Revenue Code, 2006 and will allot a registered computerized number to the same within a period of one month from today.

(2) The court concerned shall proceed to issue notice to respondent Nos. 4 to 7, and thereafter, after ensuring service of notice upon them, the said proceedings shall be disposed of in accordance with law within a period of eight months from the date of issuance of notice.
