In pursuance to the previous order dated 18.05.2023, Yamuna Expressway Industrial Development Authority, Greater Noida, Gautambudh Nagar, has filed supplementary counter affidavit stating that the representation of the petitioner has been rejected by the Board vide its resolution dated 02.09.2011. The resolution is annexed as SCA-3 to the supplementary counter affidavit.
Present petition has been filed praying for a mandamus commanding the Authority to decide the representation of the petitioner dated 18.10.2010.
In view of the aforesaid, the petition has become infructuous and it is dismissed as such. However, petitioner shall be at liberty to challenge the resolution/order dated 02.09.2011 which shall be decided on its own merit by the concerned Court.
