Heard learned counsel for the petitioner and Sri Saurabh Kumar Tripathi, learned counsel appearing for the Union of India.

Present writ petition is preferred by the petitioner seeking following principal relief:-

"(i) issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to issue a passport in favour of the petitioner in furtherance of the application dated 11.07.2022 which has been moved by the petitioner for issuing a passport in his favour, within stipulated period as directed by this Hon'ble Court.

(ii) issue a writ order or direction in the nature of the mandamus commanding the respondents to pass appropriate order on the application dated 11.07.2022 of the petitioner which has been moved by him for issuing a passport in his favour, within stipulated period as directed by this Hon'ble Court."

At the outset learned counsel for the petitioner submits that grievance of the petitioner regarding issuance of a passport would be met in case he may be permitted to file a fresh representation before respondent no. 2/Regional Passport Officer, Regional Passport Office, U.P. at Lucknow, which may be decided within a stipulated period.

No useful purpose would be served in keeping the writ petition pending.

In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of with liberty to the petitioner to file fresh representation ventilating his grievance, within two week from today, along with copy of this order before the

competent authority, which is stated to be respondent no. 2/Regional Passport Officer, Regional Passport Office, U.P. at Lucknow, who may consider the representation filed by the petitioner and decide the same in accordance with law, as expeditiously preferably within a period of two months, thereafter, from the date of receipt of the representation.
