The petitioner has preferred the present writ petition inter-alia with the prayer to quash the order dated 14.12.2022 passed by the respondent no.2, insofar as the petitioner's institution is concerned.

It is argued that wholly illegally the decision has been taken by the respondent no.2 namely Secondary Education Board, Uttar Pradesh, Prayagraj through its Secretary not permitting the petitioner's institution to become a Center of Examination in respect of forthcoming Board Examination, 2022-2023.

Pursuant to the order passed by this Court, instructions received from the office of respondent no.2 dated 10.01.2023 is placed before this Court, the same is taken on record.

It appears from perusal of the aforesaid instructions that various grounds were taken in the aforesaid instructions and on the basis of which it is argued that the petitioner's institution was rightly not made the center for examination in question. It is further argued by the learned Standing Counsel that after the decision has been taken against the petitioner and others similarly situated institution, a decision has already been taken by the respondent no.2 which was duly published in the newspapers on 12.12.2022 by which objections were sought for from the institutions, in case they are aggrieved against the decision taken by the authorities.

In this view of the matter, it is argued that though a time for submitting objections has already been expired but in case the petitioner's institution make a representation pursuant to the aforesaid notification dated 12.12.2022 within a period of seven days from today before the respondent no.2/Secondary Education Board, Uttar Pradesh, Prayagraj through its Secretary, he will take a decision in the matter within next seven days thereafter.

Heard counsel for the parties and perused the record.

In view of above, the writ petition is disposed of finally permitting the petitioner's institution to make a fresh representation pursuant to the aforesaid notification dated 12.12.2022, along-with certified copy of this order before the respondent no.2/Secondary Education Board, Uttar Pradesh, Prayagraj through its Secretary within a period of seven days from today. If it is so, the respondent no.2 is directed to take a decision in the matter, in accordance with law expeditiously and preferably within a period of seven days from the date of filing of such representation by the petitioner's institution before him.
