The present writ petition has been filed with the following prayer:

"i. Issue a writ, order, rule or direction in the nature of mandamus commanding the respondent no.2 to decide the case no.3586/2021 Computer case no.T2021180203586 (State versus Suresh Devi and others), pending in his court within a period fixed by this Hon'ble Court.

ii. Issue a writ, order, rule or direction in the nature of mandamus commanding the respondent no.2 that until the case no.3586/2021 Computer case no.T2021180203586 (State versus Suresh Devi and others), pending in his court is decided the order dated 8/4/2022 passed by learned Commissioner be incorporated in record of rights i.e. khatauni."

It is submitted by learned counsel for the petitioner that the case under Section 38 of U.P. Revenue Code is pending consideration before respondent No.2 after remand from the appellate court. The remand order was made on 8.4.2022. However till date, no order has been passed.

Learned Standing Counsel submits that the case will be decided in accordance with law in a time bound manner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, it is hereby directed that the Case No.3586 of 2021, Computer Case No.T2021180203586 (State Vs. Suresh Devi and others) pending before respondent No. 2 shall be decided within a period of four months from the date of production of a certified copy of this order without giving any unnecessary adjournment to any of the parties.

With the aforesaid observation/direction, the writ petition is disposed of.
