The instant petition has been filed praying for a mandamus directing the respondents to accord proper opportunity of hearing to the petitioner before passing the final assessment order.

The assessment proceedings are in respect of the amount of electricity charges to be paid by the petitioner in a case of theft of electricity. The entire case of the petitioner is based on the assumption that no final assessment order has been passed till date.

Learned counsel appearing for the respondent-Electricity Department has placed on record the provisional assessment order and the postal receipt evidencing that provisional assessment order was sent to the petitioner by registered post on 25.5.2022 and copy of the final assessment order dated 12.9.2022.

Copies of the aforesaid documents have also been handed over to the learned counsel for the petitioner.

Since final assessment order has already been passed, therefore, the prayer made in the instant petition no more survives.

¶10

The writ petition is disposed of with liberty to the petitioner to challenge the final assessment order in independent proceeding, if so advised.
