Heard Mr. Sudhir Srivastava, learned counsel for the petitioner, Mr. Abhinav Ojha, learned learned Standing Counsel for the State-respondents and Mr. Azad Rai, learned counsel for respondent no.3 / Gaon Sabha.

The instant petition has been filed for mandamus directing the respondent no.2 / Additional Commissioner First, Prayagraj Division, Prayagraj to decide the Revision No.T2002020000105, under Section 219 of U.P. Land Revenue Act, 1901 within stipulated period.

Learned counsel for the petitioner submitted that the aforementioned revision filed on behalf of the contesting respondent no.4 to 14 arising out of mutation proceeding is pending before respondent no.2 since 13.9.2002. He further submitted that petitioner is opposite party in the pending revision. He next submitted that certified copy of the order sheet of the pending revision is annexed as Annexure No.4 to the petition in order to demonstrate that the revision is still pending in spite of the expiry of 21 years.

Without expressing any opinion on merits of the case and keeping in view of the facts and circumstances, respondent no.2 is directed to decide the aforementioned revision on merits after giving an opportunity of hearing to the parties in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order before him.

Accordingly, the writ petition is finally disposed of.
