Heard Sri Pranab Kumar Ganguli, learned counsel for petitioners and Sri S.K. Verma along with Sri Daya Ram Singh, learned counsel for respondent nos.5 to 7 as well as Sri Satyendra Bhushan Dubey, learned Standing Counsel for the Staterespondent nos.1 to 3.

On previous occasion, instructions have been received through learned Standing Counsel through which it has been transpired that the order dated 11.07.2014 which impugned the present petition, has already been sought to be recalled/reviewed vide application no.3819 of 2023 which has been preferred on behalf of respondent nos.1 to 3 on dated 21.11.2023 before learned Board of Revenue.

The order dated 11.07.2014 is under challenge in the instant petition and the same has been sought to be recalled/reviewed after a gap of near about ten years but during pendency of the same, no useful purpose will be served in keeping the matter pending by way of calling counter affidavit on behalf of respondents.

In the interest of justice, this petition is hereby disposed of with liberty to petitioners to take action permissible as per law after outcome of the application no.3819 of 2023 preferred by respondent nos.1 to 3 before the Board of Revenue.

However, learned Board of Revenue is directed to expedite the disposal of application no.3819 of 2023 preferred by respondent nos.1 to 3 as expeditiously as possible, preferably within a period of three months from the date of production of a certified copy of this order before it.
