Heard Sri learned counsel for the petitioners and Sri Amit Kumar Srivastava, learned standing counsel for the staterespondents.

The instant writ petition has been filed, seeking a writ of mandamus, commanding respondent no.3/S.D.M., Karvi, Chitrakoot to decide Case No.T202307190104292, under Section 24 of the U.P. Revenue Code, 2006, within the stipulated time.

Counsel for the petitioners states that proceeding under Section 24 of the U.P. Revenue Code, 2006 initiated in January, 2023, has been registered but no final decision has been taken in the matter. He further submitted that Section 24(3) of the U.P. Revenue Code, 2006 provides for disposal of the proceeding under Section 24 of the U.P. Revenue Code, 2006 within a period of 90 days but the provision has not been followed.

In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, this petition is disposed of with the direction to respondent no.3 to decide the aforesaid proceedings to its logical conclusion, as expeditiously as possible, preferably within a period of 3 months, from the date of production of a certified copy of this order before the authority concerned, after affording proper opportunity of hearing to the parties concerned, in accordance with law.
