Heard Sri Prem Shanker, holding the brief of Sri Ashok Kumar Yadav, for the petitioner, Sri Abhishek Shukla, learned Addl. C.S.C. for the state-respondents and Sri Sudhir Bharti, learned counsel for the respondent-gaon sabha.

The instant writ petition has been filed, seeking a writ of mandamus, commanding respondent no.2/Commissioner, Gorakhpur Division, Gorakhpur to decide Case No.00700/2018 (Computerized Case No.C201805000000700) (Sumitra Devi vs. Ramesh), under Section 219 of the U.P. Land Revenue Act, 1901, within the stipulated time.

Counsel for the petitioner states that the aforesaid revision filed on behalf of the petitioner, arising out of the proceeding under Section 34 of the U.P. Land Revenue Act is pending before respondent no.2 since 2018. He further placed the certified copy of the order sheet which has been annexed as Annexure No.3 to the writ petition, in order to demonstrate that the case is not proceeding expeditiously.

In view of the facts and circumstances of the case, without expressing any opinion on the merits of the case, this petition is disposed of with the direction to respondent no.2 to decide the aforesaid proceedings to its logical conclusion, as expeditiously as possible, preferably within a period of 3 months, from the date of production of a certified copy of this order before the authority concerned, without granting unnecessary adjournments to either of the parties, in accordance with law.
