Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.

The present writ petition is preferred for the following reliefs :-

"(i) issue a writ, order or direction in the nature of mandamus directing the respondent no. 3 to release the handicapped pension of the petitioner in accordance with law.

(ii) issue a writ, order or direction in the nature of mandamus directing the respondent no. 3 to decide the representation of the petitioner dated 30.09.2023 within stipulated time."

Learned counsel for the petitioner submits that petitioner has already represented his case through representation but till date, the same has not been redressed.

Learned Standing Counsel very fairly submits that, in case, any such representation is pending, the same would be decided by the concerned authority.

Considering the facts and circumstances, no useful purpose would be served in keeping the writ petition pending consideration.

Considering the the facts and circumstances, without expressing any opinion on the merits of the case, the Writ Petition is disposed of with the direction to respondent no. 3 - Sub-Divisional Magistrate, District- Basti to consider and decide the petitioner's application/representation dated 30.09.2023 strictly in accordance with law within three weeks from the date of production of certified copy of this order. Suffice to indicate that the Court has not adverted on the merits of the case.
