Heard learned counsel for the petitioner and Mr. Govind Kumar Saxena, learned Additional Chief Standing Counsel for the State-respondents.

The instant petition has been filed for mandamus directing the respondent no.3 i.e. Nayab Tahsildar, Tahsil- Kasaya, Disrict- Kushinagar to decide the mutation case No.T202005440405201 (Vasir @ Vajir vs. Kadim), under Section 35 of U.P. Revenue Code, 2006 within stipulated period.

Learned counsel for the petitioner submitted that the aforementioned mutation case is pending since 22.10.2020 although Rule 34 (7) of U.P. Revenue Code Rules, 2016 provides for disposal of contested cases within 90 days and uncontested cases within 45 days otherwise reasons be recorded by the Court concerned.

Without expressing any opinion on merits of the case and keeping in view of the facts and circumstances, respondent no.3 is directed to decide the aforementioned mutation case on merits after giving an opportunity of hearing to the parties in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order before him.

Accordingly, the writ petition is finally disposed of.
