Heard learned counsl for the petitioner, Mr. Utpal Kumar Nishad, learned Standing Counsel for the State, Mr. Azad Rai, Advocate for respondent no.3.

The instant petition has been filed for mandamus commanding respondent no.2 Sub Divisional Officer, Meja, District Prayagraj to decide Case No. T20220203080342 of 2022 (Krishna Kumar @ Krishna Chandra and another vs. Alok Kumar Singh and others) under section 116 of U.P. Revenue Code, 2006 within a stipulated period.

Learned counsel submitted that the aforementioned partition suit filed by the petitioner is pending since 2022. He further submitted that copy of the ordersheet has been annexed as Annexure No.3 to the writ petition in order to demonstrate that the case is not proceeding in accordance with the provisions contained under Rule 109 (10) of U.P. Revenue Code Rules, 2016.

Considering the facts and circumstances, the instant petition is finally disposed of directing respondent no.2 to conclude the proceedings of the aforementioned suit in accordance with law after affording proper opportunity of hearing to the parties expeditiously preferably within a period of four months from the date of production of certified copy of this order.
