Heard Shri Vijay Sinha, learned counsel for the petitioner and Shri Akhileshwar Singh, learned Additional Chief Standing Counsel appearing for the State respondents.

Considering the nature of the order proposed to be passed notice upon the private respondents are being dispensed with.

The present writ petition has been filed seeking issuance of a writ of mandamus commanding the respondent no. 3 to sanction the building map which is stated to be pending since 06.06.2023.

Shri Vijay Sinha, learned counsel for the petitioner submits that the purpose of filing the present writ petition shall stands served if the appropriate directions are issued to the respondent no. 3 i.e. Additional District Magistrate (F& R)/ Secretary Baghpat-BarautKhera Development Authority, Baghpat, to take appropriate decision on the pending application of the petitioner seeking sanction of map.

Learned counsel representing the State respondents have no objection the aforesaid proposition.

This Court is also of the opinion that no useful purpose would be served by keeping the writ petition pending and the same is accordingly disposed of by requiring the respondent No. 3 Additional District Magistrate (F& R)/ Secretary Baghpat-BarautKhera Development Authority, Baghpat, seized with the petitioner's application dated 06.06.2023, for sanction of map, to consider all aspects of the matter and pass appropriate orders, after hearing the parties concerned, expeditiously, preferably within a period of three weeks, from the date of production of certified copy of order of this Court.

Needless to say that this Court has not expressed any opinion on the merits of the case and it shall be open for the respondent No. 3 to pass appropriate orders, strictly in accordance with law.
