Heard Sri Achyutanand Pandey, learned counsel for the petitioners and Sri Anand Bhaskar Srivastava, learned Standing Counsel appearing for the State-respondents.
The present petition has been filed seeking to to raise grievances that the private respondent Nos. 5 and 6 are interfering in the possession of the petitioners over the land which is stated to have been allotted to them by way of a residential lease.
Counsel for the State respondents submits that pursuant to the previous order instructions dated 19.08.2023, have been received from the respondent No. 2, indicating therein that the land in question is a Gram Sabha land and the documents which have been appended along with the writ petition to assert the claim with regard to allotment in favour of petitioners, are doubtful and no record in this regard are available.
It is further submitted that there is a dispute between the petitioner and the private respondents with regard to possession, and the State authorities are proposing to initiate appropriate proceedings in respect of the Gram Sabha land.
Learned State Counsel submits, on the basis of the instructions, that the reliefs sought in the writ petition cannot be granted.
The petition stands dismissed accordingly .
