Heard Sri Awadhesh Tiwari, learned counsel for the petitioner, learned Additional Chief Standing Counsel for the State-Respondent No.1 and Sri Pankaj Kumar Gupta, learned counsel for the Respondent No.2.

At the very outset learned counsel for the petitioner submits that the injunction application dated 09.01.2023 filed by the petitioner in Case No. T202317140200102 (Amar Nath Singh and others Vs. Chairman Land Management Committee, Village Sansarpur, Tapp Sikandarpur, Pargana Basti Purab, Tehsil Bhanpur, District Basti) under Section 116 of the U.P. Land Revenue Code, 2006 is pending consideration and purpose of filing of this writ petition shall stand served if appropriate directions are issued to the Sub Divisional Magistrate (Judicial) Bhanpur, District Basti to decide the injunction application within the stipulated period of time.

Learned counsel for the respondents have no objection to the aforesaid proposition.

Considering the innocuous prayer made by the petitioner for expeditious disposal of the injunction application, the writ petition is disposed of by requiring the Sub Divisional Magistrate (Judicial) Bhanpur, District Basti, to consider and decide the injunction application dated 09.01.2023 filed by the petitioner in Case No. T202317140200102 (Amar Nath Singh and others Vs. Chairman Land Management Committee, Village Sansarpur, Tapp Sikandarpur, Pargana Basti Purab, Tehsil Bhanpur, District Basti) under Section 116 of the U.P. Land Revenue Code, 2006, within a period of one month from the date of service of certified copy of this order, strictly in accordance with law.

Needless to say that this Court has not expressed any opinion on the merits of the claim of the petitioner and it shall be open for the Sub Divisional Magistrate (Judicial) Bhanpr, District Basti to decide the same strictly in accordance with law.
