By order dated 11.7.2023, this Court had granted one more opportunity to the State-respondents to comply with the earlier orders of this Court dated 19.5.2023 and 30.5.2023, failing which the respondent No. 3, Tehsildar, Teshil Phoolpur, District Prayagraj was directed to appear in person before this Court.
Learned Addl. Chief Standing Counsel submits that instructions have been received on 6.7.2023 under which it has been stated that mutation case under Section 34 of the U.P. Revenue Code, 2006 has since been decided vide order dated 20.6.2023 and it is accordingly submitted that relief prayed for in the writ petition has now been rendered infructuous.
Learned Addl. Chief Standing Counsel has also handed over a copy of the order dated 20.6.2023 to learned counsel for the petitioner.
In the opinion of the Court since the relief prayed for in the writ petition has already been granted nothing further survives for adjudication by this Court. The writ petition is dismissed as having been rendered infructuous .
