This writ petition has been filed seeking following reliefs:-

"(i) Issue a writ, order or direction in the nature of mandamus directing to the Principal Secretary, Nagar Vikas Vibhag, U.P. Government, Lucknow to consider and take appropriate decision on the inquiry report dated 10.01.2022 and 02.04.2022 submitted by the inquiry committee and on the recommendation sent by the District Magistrate, District Bijnor through its letter dated 05.04.2022, expeditiously within short span of time.

(ii) Issue a writ, order or direction in the nature of mandamus directing the State Government to take necessary steps against the responsible officers for making false assurance before this Hon'ble Court and for committing intentional delay in taking decision in the present matter."

Taking notice such grievance, this Court passed following orders on 20.7.2023:-

"Submission is that Principal Secretary, Nagar Vikas Department, Lucknow in his affidavit filed in petitioner's earlier petition assured the Court that necessary decision would be taken shortly on the enquiry report, yet nothing has been done.

Learned State Counsel, therefore, is directed to obtain specific instructions from the second respondent and apprise the Court about the status of the matter.

Put up as fresh on 4.8.2023."

Instructions have been obtained from the respondents by the learned State Counsel Sri Ishan Mehta, as per which charge nos.2 and 3 have been found proved but the liability of the responsible officer has not been determined. The State Government has called for certain comments from the District Magistrate, Bijnor vide order dated 27.7.2023. The District Magistrate, Bijnor has sent a reply in the matter on 1.8.2023. It appears that the State Government is yet to take a final decision in the matter.

In the facts of the case, we dispose of this writ petition with a

direction upon the second respondent to ensure that proceedings of enquiry initiated against the private respondent nos.5 to 7 is concluded, by passing appropriate orders, in accordance with law, after notice to the private respondent nos.5 to 7, and by following the procedure specified in the applicable rules, within a period of three months from the date of presentation of a certified copy of this order.
