Heard learned counsel for the petitioners; Sri Ambrish Shukla, learned Additional Chief Standing Counsel for the State-respondent and Sri Mayank Kumar Ranjan holding brief of Sri K.M.Asthana, learned counsel for the respondent-Bank.

The present writ petition has been preferred for a mandamus commanding the respondent no. 2 and 3 to recognize the signature of petitioner no. 2 and to permit the petitioner to operate the bank account no. 2837101010899 of Canara Bank, Khirani Bagh Branch, Shahjahanpur.

The matter was taken on 20.9.2023 and this Court has asked Sri Ambrish Shukla to seek instructions.

Today, Sri Ambrish Shukla has placed the instructions dated 7.10.2023 sent by Assistant Registrar, Firms, Societies and Chits, Bareilly indicating therein list of general meeting 2022-23 was presented by the second petitioner for approval/recognition and has been accepted on 28.08.2023, copy of which has been annexed along with instructions. It has also been apprised that the management list for the 2023-24 has also been produced by the second petitioner for registration, which has also been accepted on 26.09.2023, copy of which is also appended along with instructions filed today.

Confronted with this situation, Sri Mishra, learned counsel for the petitioners submits that the direction may be issued to the respondent-Bank to attest the signature of the second petitioner as Manager of the society in question. Learned counsel for the respondent-Bank has no objection to the same.

Considering the facts and circumstances of the case, as the Assistant Registrar has already proceeded under the

Registration Act and learned counsel for the Bank has also acknowledged the claim of the petitioners, the cause for filing of the writ petition no more survives.

Consequently, the writ petition stands disposed of in terms of the aforesaid.
