Heard Shri Alakshyendra Goel, learned counsel for the petitioner and learned Standing Counsel for the Staterespondents.

Consider the nature of the order that is proposed to be passed, the notice upon private respondents is being dispensed with.

At the very out set, learned counsel for the petitioner submits that restoration application seeking recall of the order dated 16.1.2023 passed under Section 24 of the U.P. Revenue Code, 2006 is stated to be pending and purpose of filing the present writ petition shall stand served, if directions are issued to the respondent No. 2 to consider and pass final orders on the pending restoration application within the time frame fixed by this Court.

Learned Standing Counsel has no objection to the aforesaid proposition.

This Court is also of the opinion that no useful purpose shall be served by keeping the writ petition pending and accordingly, the writ petition stands disposed of by requiring the Sub Divisional Magistrate, Tehsil Badlapur, District Jaunpur seized with the restoration application of the petitioner dated 12.4.2023 filed in Case No. T202214360205703 (Ramdas versus Gram Panchayat) under Section 24 of the U.P. Revenue Code, 2006 to consider and decide the same expeditiously, preferably within a period of six weeks from the date of service of certified copy of the order of this Court.

Needless to say that this Court has not expressed any opinion on the merit of the case and it shall be open for the said respondent to pass order, strictly in accordance with law after affording due opportunity to all the parties concerned.
