Heard Sri Ramesh Singh Kushwaha, learned counsel for the petitioner, Sri Anand Bhaskar Srivastava, learned Standing Counsel appearing for the State-respondents and Sri Kamlesh Kumar Sharma, learned Advocate holding brief of Sri Bhupendra Kumar Tripathi, learned counsel representing the respondent Gram Sabha.

Counsel for the petitioner after making submissions to some extent confines his relief to Prayer No. ii, which is for a direction to the respondent No. 5 to decide the Case No. T201914180100137 (Amar Dev Vs. State), under Section 24 of the U.P. Revenue Code, 2006, within a stipulated time period.

Counsel for the State respondents submits that as per instructions dated 28.07.2023 received from the respondent No. 5, proceedings under Section 24 of the U.P. Revenue Code, 2006 instituted at the behest of the petitioner, are pending and efforts are being made to conclude the proceedings at an early date, after giving due opportunity to the parties concerned.

Counsel for the petitioners though not disputing the aforestated stand taken by the State respondents, seeks expeditious disposal of the pending proceedings.

Having regard to the aforementioned facts and circumstances, the present petition is disposed of with an observation that the respondent No. 5 would make an endeavour to decide the aforesaid case in accordance with law expeditiously, preferably within a period of three months from the date of presentation of a certified copy of this order, provided there is no other legal impediment.
