Heard learned counsel for the petitioner and Shri Sarveshwar Lal Srivastava, learned counsel appearing for Union of India.

Present writ petition has been preferred for following relief:-

"(i) issue a writ, order or direction in the nature of mandamus commanding the respondent no.2 to correct the name of father of the petitioner as "Surender Singh" instead of "Surendra Singh" in passport number T7792570 and date of birth of petitioner as "28.04.1999" instead of "28.04.1997" within certain stipulated period of time."

Learned counsel for the petitioner has submitted that similar controversy has earlier been raised before this Court by preferring Writ-C No. 36294 of 2016 (Mohd. Yaseen v. Union of India & 02 Others), which was disposed of on 20.8.2016. In the said writ petition, the co-ordinate Bench of this Court while considering the order dated 10th September, 2014 issued by the Ministry of External Affairs had observed that the issues relating to correction of the date of birth as recorded in a passport would necessarily entail an enquiry into facts which can best be addressed, looked into and remedied by the passport authorities themselves at the first instance. Finally, the said writ petition was disposed of in the light of the Office Memorandum dated 26th November, 2015 leaving it open to the petitioner to approach the Regional Passport Officer to seek redressal of his grievances in the light of the Office Memorandum and Supplementary Instructions issued in this regard. In this backdrop, learned counsel for the petitioner submits that the petitioner being on similar footing is also entitled for similar indulgence and the present writ petition may also be disposed of in terms of Mohd. Yaseen (supra).

So far as the factual and legal aspect of the matter is concerned, the same could not be disputed by learned counsel for Union of India.

In the facts and circumstances of the case, we are not inclined to

keep the matter pending consideration. The present writ petition stands disposed of in terms of Mohd. Yaseen (supra).
