The instant petition has been filed praying for a mandamus directing the State-respondents to take decision on the complaint of the petitioner having regard to the inquiry report dated 28.3.2019.

The petitioner is a registered co-operative society. It had applied for availing benefit of 'Credit Link Based Ended Subsidy Scheme' of the State Government. An amount of Rs.9,00,000/- was sanctioned by the Bank in favour of the petitioner society for purchase of agricultural equipments under the said Scheme. It seems that at the time of survey carried out by the respondents to ascertain whether the equipments had been purchased or not, the equipments were found missing and consequently the benefit under the Subsidy Scheme was cancelled. Later on, the petitioner made an application requesting for a fresh inquiry and in response thereof, it seems that an inquiry was held and a report was submitted on 28.3.2019.

Learned Counsel for the petitioner submits that respondent no.3, Director Agriculture, U.P. Government, Lucknow vide a communication dated 19.8.2019 addressed to the concerned

Secretary of the Agriculture Department of the Government of U.P. sought guidance in light of the application of the petitioner and the fresh inquiry held in pursuance thereof. The case of the petitioner is that the State Government has not issued any direction so far and therefore, the matter had remained pending since then. He submits that the State-respondents be directed to take decision in the matter expeditiously.

Learned Addl. Chief Standing Counsel Sri Dilip Kesarwani has no objection to the same.

Accordingly, without expressing any opinion on merits of the case, the petition is disposed of with liberty to the petitioners to make a fresh representation before the respondent no.1 along with true attested copy of the instant order and in which event, the same shall be decided by the Special Secretary, Agriculture, Government of U.P., Lucknow or such other authorities who is competent to take decision in the matter on behalf of the State Government within a period of twelve weeks from the date of receipt of the representation.
