This Court has passed following order on 31.03.2023:-

"Heard Mr. Rajesh Kumar Singh and Mr. Krishna Kant Vishwakarma, learned counsel for the petitioner, learned Standing Counsel for the Staterespondents and Mr. Rameshwar Prasad Shukla, learned counsel for the respondent- Land Management Committee.

Learned counsel for the petitioner submitted that the proceeding under Rule 109 A of U.P.C.H. Rules has been initiated by the petitioner which has been registered as Case No.7 of 2022 in pursuance of the final order passed by the Deputy Director of Consolidation dated 7.9.2022. He further submitted that the Consolidation Officer is not proceeding in accordance with law in spite of the submission of the report of Consolidation Officer/ Assistant Consolidation Officer dated 3.2.2023. He next submitted that appropriate direction be issued to the Consolidation Officer to conclude the proceeding as well as to pay the additional compensation to the petitioner as litigation is pending since 1982 due to act of the authorities.

Without expressing any opinion on merits of the case and keeping in view of the facts and circumstances, respondent no.4 i.e. Consolidation Officer Sadar, District- Mau is directed to conclude the proceeding of Case No.7 of 2022 under Rule 109 A of U.P.C.H. Rules in accordance with law expeditiously preferably within a period of eight weeks from the date of production of certified copy of this order before him.

List this case in the additional cause list on 29.5.2023.

On the next date, the further prayer of the petitioner shall be considered by this Court."

Since none has appeared on behalf of petitioner, therefore in the

light of the above order, this writ petition is not required to keep pending and therefore, this writ petition is disposed of with the direction to the concerned Authority to conclude the proceeding expeditiously at the earliest if already not concluded and a report thereof be submitted before Commissioner Consolidation, Lucknow.

The writ petition is disposed of accordingly.
