On due consideration, the application is allowed and the case is taken up today itself.

Heard the counsel for the petitioner and Sri Shobhit Mohan Shukla, the counsel for the respondents.
The present petition has been filed by the petitioner claiming that the petitioner is entitled to the benefit of the Government Order dated 09.12.2003 in view of the services rendered by the petitioner as an untrained teacher.
The petitioner claims that he has filed an application for grant of the benefits which flow from the Government Order dated 09.12.2003, however, no decision has been taken.
Considering the said submissions and the fact that the decision is to be taken by the respondent no.2, the present petition is disposed of permitting the petitioner to file a fresh application before the respondent no.2 seeking the benefits as claimed by him. In case such an application is filed, the respondent no.2 shall take a decision thereupon in accordance with law within a period of two months. The petitioner would be at liberty to place reliance on such materials as may be advised in accordance with law.
