Heard Sri A.P. Pandey, learned counsel holding brief of Sri Mohan Kant Baghel, learned counsel for the petitioner and Sri Rajesh Kumar Tiwari, learned Additional Chief Standing Counsel.

The present petition has been filed seeking a direction in the nature of mandamus to be issued in favour of the respondent no.3 to release the balance of G.P.F. to the petitioner.

It is the case of the petitioner that in spite of superannuation of the petitioner on dated 31.03.2019, no retiral dues has been extended in favour of the petitioner till today.

On earlier occasion, specific instructions have been called from the responding authorities. Today, when the matter was taken up, learned Additional Chief Standing Counsel came up with the instructions issued by the District Basic Education Officer, Etah through which it has been transpired that certain documents required from the Finance and Accounts Officer, office of the District Basic Education Officer, Firozabad, are still to be obtained, due to pendency of the same, the retiral dues as incurred in favour of the petitioner has not been extended till today.

Learned counsel for the petitioner raised his arguments for seeking the prayer as made in the petition that the petitioner is nowhere at fault for any delay whatsoever has been caused due to inaction as carried out by the responding authorities. It is also evident from the instructions that certain documents which are required is inter-se communication which has put much earlier but under which circumstances, the same has not been sent by the concerned authority and the same has not been received by the competent authority till today?

In view of the aforesaid facts and circumstances, the respondent no.3 is hereby directed to finalize the entire proceedings well within a month and extend the benefit of retiral dues in favour of the petitioner for which, if he is legally entitled.

Accordingly, the writ petition stands disposed of.
