Heard Sri Sanjeev Kumar Rai, learned counsel for the petitioner, Sri Sujeet Kumar Rai, learned counsel, who is representing respondents no. 2 and 3 and learned Standing Counsel, who has accepted notice on behalf of respondent no.1.

The petitioner, who has been working on Class-IV post as driver with the respondents, has approached this Court claiming issuance of writ of mandamus commanding the respondent no.2 to provide the seniority and consequential benefits to the petitioner treating him in service from the date of his appointment, i.e. 03.05.2000.

At the very outset learned counsel for the petitioner submits that the petitioner may be permitted to file comprehensive representation clearly stating his claim, which may be directed to be decided within the time frame fixed by this Court.

Learned counsel for the contesting respondents no. 2 and 3 submits that the claim of the petitioner shall be decided in accordance with law.

This Court is also of the opinion that the writ petition may be disposed of finally by directing the respondent no. 2 to consider and decide the claim of the petitioner for grant of seniority and consequential benefits from the date of his initial engagement.

Accordingly, the writ petition is disposed of by requiring the petitioner to file comprehensive representation addressed to the respondent no. 2 clearly stating therein his claim within a period of two weeks from today, thereafter, in the eventuality of such representation being moved within the time allowed by this Court, it is expected that the respondent no.2 shall proceed to consider all aspect of the matter and pass appropriate orders on such representation, expeditiously, preferably within a period of two months from the date of filing of the representation along with certified copy of this order.

Needless to say that this Court has not expressed any opinion on the merits of the claim of the petitioner and it would be open to the respondent no. 2 to consider and pass appropriate orders on the representation of the petitioner, strictly in accordance with law.
