Heard learned counsel for the petitioner and Shri Gyan Prakash Singh, learned counsel for the respondents, who has raised an objection that the matter can be agitated by the petitioner before the Central Administrative Tribunal.
Learned counsel for the petitioner, after arguing at some length, submits that he may be permitted to withdraw the petition with liberty to approach the Central Administration Tribunal concerned.
In view of the aforesaid, the petition is dismissed as withdrawn with liberty to raise the issue before the Tribunal concerned.
It is made clear that the matter has been remitted only on the ground of availability of alternative remedy and the Court has not examined the case of the petitioner on merits.
