Heard Shri Ram Raj Prajapati, learned counsel for the petitioner and Shri Santosh Kumar, learned counsel, representing the respondent no. 3. Learned Standing Counsel has accepted notice on behalf of the respondent nos. 1 and 2.

Learned counsel for the petitioner at the very outset submits that the petitioner has preferred a representation dated 10.11.2022, addressed to the respondent no. 3, claiming compassionate appointment on the suitable post, consequent to the death of his mother, who died in harness while working as Assistant Teacher. He submits that the purpose of filing this writ petition would be served if directions are issued to the respondent No. 3, District Basic Education Officer, Shahjahanpur, to pass appropriate orders on the pending representation of the petitioner.

Learned counsel appearing for the respondents submit that they have no objection to the aforesaid proposition.

Considering the submissions advanced, this Court is of the opinion that no useful purpose would be served by keeping the writ petition pending and the same is accordingly, disposed of requiring the respondent No. 3, District Basic Education Officer, Shahjahanpur, seized with the representation of the petitioner dated 10.11.2022, to pass appropriate orders thereon, after considering all aspects of the matter, strictly in accordance with law, preferably within a period of two months from the date of service of a certified copy of the order of this Court.

Needless to say that this Court has not expressed any opinion on the merits of the case and it shall be open for the respondent No. 3, District Basic Education Officer, Shahjahanpur to pass appropriate orders, in accordance with law.
