Heard learned counsel for the petitioner as well as learned Standing Counsel.

By means of this petition filed under Article 226 of the Constitution, the petitioner is claiming notional promotion as his junior Girish Chandra Pandey had been granted promotion on 01.11.1993 on the post of Boring Technician.

It is submitted by the petitioner that in view of the discrimination meted out to the petitioner ignoring seniority in according promotion benefits, petitioner is suffering financial loss. He submits that in the above regard he has already made a representation to the respondent no. 3 namely the Executive Engineer, Minor Irrigation Department, Region Firozabad on 27.07.2022 which has remain pending consideration till date.

Learned Standing Counsel submits that he has no objection in the event this petition stands disposed of with a direction to the respondent no. 3 to look into and consider the grievance of the petitioner and pass appropriate order strictly in accordance with law.

In view of the above, this petition stands disposed of with a direction that respondent no. 3 shall consider the grievance of the petitioner raised in his representation dated 27.07.2022 and decide the same within a period of two months from the date of receipt of certified copy of this order giving full opportunity of hearing to the petitioner.

Needless to add that the order to be passed by the competent authority, as directed herein above, shall be reasoned and speaking one.
